Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of UNIMART AFRICA ("UNIMART", "we", "our", or "us"), including our website, mobile experiences, AI features (such as Junior and My Agent), commerce tools, opportunity boards, and related services (the "Platform").

By creating an account, accessing, or using the Platform, you agree to these Terms, our Privacy Policy, Cookie Policy, AI Usage & Transparency Policy, and Acceptable Use Policy.

If you do not agree, do not use the Platform.

2. Who May Use UNIMART

UNIMART is intended primarily for university and college students and other adults who can form a binding contract under applicable law.

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for activity under your account and for keeping your credentials secure.
  • One person or organization should not maintain multiple accounts to evade limits, bans, or fees.

3. The Platform

UNIMART helps users discover and engage with campus commerce, services, businesses, opportunities, entrepreneurship resources, and personalized assistance. Features may change, expand, or be discontinued as we improve the Platform.

UNIMART is a technology platform. Unless we expressly state otherwise in writing, we are not the seller of goods, the employer, the scholarship provider, or the party offering an opportunity listed by a third party.

4. Accounts and Eligibility

  • You may need a campus, institution, or phone/email verification to access certain features.
  • We may refuse, suspend, or terminate accounts that violate these Terms or pose risk to users or the Platform.
  • You must promptly notify us of unauthorized use of your account at [email protected].

5. User Content

"User Content" includes listings, profiles, reviews, applications, messages, uploads (such as CVs or product photos), and other material you submit.

  • You retain ownership of your User Content.
  • You grant UNIMART a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your User Content as needed to operate and promote the Platform.
  • You represent that you have the rights to submit User Content and that it does not infringe others' rights or violate law.
  • We may remove or restrict User Content that violates these Terms or our Acceptable Use Policy.

6. Commerce, Orders, and Payments

  • Buyers and sellers are responsible for the accuracy of listings, pricing, fulfillment, and communication.
  • Product sellers are also bound by our Seller Terms; service providers by our Service Provider Terms.
  • Payment processing may be handled by third-party providers; their terms also apply.
  • Fees, commissions, or boosts (if any) will be disclosed where applicable before you confirm a charge.
  • Disputes between buyers and sellers should first be resolved between the parties; we may assist at our discretion but are not obligated to mediate every dispute.

7. Opportunities and Applications

Opportunity listings may be posted by employers, organizations, campuses, or other partners. UNIMART does not guarantee interviews, placements, funding, or outcomes. You are responsible for the accuracy of applications and documents you submit.

8. AI Features

AI features may provide recommendations, summaries, conversational help, and workflow assistance. Outputs can be incomplete or incorrect. AI assistance is not professional, legal, financial, medical, or career advice. See our AI Usage & Transparency Policy.

9. License to Use the Platform

We grant you a limited, revocable, non-transferable license to access and use the Platform for its intended purposes, subject to these Terms and our Acceptable Use Policy. You may not copy, scrape, reverse engineer, or exploit the Platform except as allowed by law or with our prior written consent.

10. Intellectual Property

UNIMART branding, software, design, and platform content (excluding User Content) are owned by UNIMART or its licensors. You may not use our marks without permission.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free service, or that listings, recommendations, or AI outputs are accurate or complete.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNIMART AND ITS AFFILIATES, OFFICERS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.

Our aggregate liability for claims relating to the Platform will not exceed the greater of (a) the amounts you paid to UNIMART for paid services in the twelve (12) months before the claim, or (b) USD 50 (or local currency equivalent), except where liability cannot be limited by law.

13. Indemnity

You agree to defend and indemnify UNIMART against claims arising from your User Content, your use of the Platform, your transactions with other users, or your violation of these Terms or applicable law.

14. Suspension and Termination

You may stop using the Platform at any time. We may suspend or terminate access for violations, risk, inactivity, or operational reasons. Provisions that by nature should survive (including IP, disclaimers, liability limits, and indemnity) will survive termination.

15. Changes

We may update these Terms from time to time. Material changes will be communicated through the Platform, email, or other reasonable channels. Continued use after the effective date constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of Kenya, without regard to conflict-of-law principles, unless mandatory consumer protections in your place of residence require otherwise. Courts in Kenya shall have jurisdiction, subject to applicable mandatory rights.
